Terms & Conditions

Important
These Terms constitute a legally binding agreement between you and the operator of InfluxTV. By accessing, registering on, or using the Platform, you agree to be bound by these Terms in their entirety. Please read them carefully before using the Platform.
If you do not agree to any provision of these Terms, you must not access or use the Platform.
01Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the InfluxTV platform, accessible at www.influxtv.in and through associated mobile applications (collectively, the "Platform"). The Platform is owned and operated by Aignan Mediatech Private Limited, a company incorporated under the Companies Act, 2013 (CIN: U63122HR2026PTC145430, GSTIN: 06ABFCA6652B1ZZ), with its registered office at 3rd Floor, E52, TDI The Retreat, Sector 89, Faridabad, Haryana, 121002, India, trading under the brand name "InfluxTV" (referred to as "InfluxTV", "the Company", "we", "our", or "us").
These Terms apply to all persons who access or use the Platform in any capacity, whether as a Viewer (User) or as a Creator. By creating an account, accessing any feature of the Platform, or making any transaction including the purchase of Flints, you acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms.
These Terms are to be read in conjunction with the following documents, which are incorporated herein by reference:
- The InfluxTV Privacy Policy
- The InfluxTV Refund and Cancellation Policy
In the event of any conflict between these Terms and any of the above documents, these Terms shall prevail to the extent of the conflict, unless the conflicting provision relates to data privacy (in which case the Privacy Policy shall prevail) or to refunds (in which case the Refund and Cancellation Policy shall prevail).
Delivery
InfluxTV does not deal in physical goods. Flints are delivered electronically and instantly to the Viewer's Flint Wallet upon successful payment confirmation, as described in Clause 5. No physical shipment, courier, or delivery timeline applies to any transaction on the Platform.
02Definitions
"Platform"
The InfluxTV website at www.influxtv.in, its mobile applications, and all associated services owned and operated by Aignan Mediatech Private Limited
"Viewer"
An individual who registers on the Platform to watch live streams, participate in interactive events, and spend Flints — also referred to as "User"
"Creator"
An individual or entity who registers on the Platform to host live streams, launch interactive events, and receive earnings through the Creator Wallet
"Account"
A registered user account on the Platform, whether a Viewer Account or a Creator Account
"Flints"
The closed-system virtual currency native to InfluxTV, purchasable through the Flint Shop and usable exclusively within the Platform ecosystem
"Flint Shop"
The in-Platform interface through which Viewers purchase Flints using real-world currency (INR)
"Flint Wallet"
The in-platform ledger that records a user's Flint balance, purchase history, and spend history
"Creator Wallet"
The in-platform ledger that records a Creator's earnings from viewer interactions, subject to platform commission deduction and payout processing
"Platform Interaction"
Any action taken by a Viewer that consumes Flints, including live bidding, poll voting, POV event participation, and any other Flint-denominated feature
"Bid Event"
A time-bound, creator-launched interactive event in which Viewers compete by spending Flints, with outcomes determined by bid value or other defined criteria
"XP (Experience Points)"
A non-monetary, non-transferable metric that accrues to both Viewers and Creators based on platform participation, used for leaderboard ranking and status progression
"Leaderboard"
Public ranking of Viewers or Creators based on cumulative XP, displayed at the in-stream level and at the platform-wide global level
"KYC Data"
Know-your-customer information submitted by Creators for identity verification and payout eligibility, including PAN card details, Aadhaar details, and bank account information
"Parent-Authorized Payment Instrument"
Any UPI handle, prepaid wallet, or payment instrument that, by design or terms of the issuing institution, requires a parent or legal guardian to authorize the account and is linked to a guardian-controlled funding source
"Platform Commission"
The percentage of Flint-based earnings retained by InfluxTV before Creator payouts are processed
"TDS"
Tax Deducted at Source under the Income Tax Act, 1961, as applicable to Creator earnings on the Platform
03Eligibility and Age Requirements
3.1 Minimum Age — Viewers
The Platform is intended for Viewers who are 18 years of age or older. By creating an Account, you represent and warrant that you are at least 18 years of age.
Declaration required at purchase:
"I confirm that I am 18 years of age or older, OR that I am a user whose parent or legal guardian has authorized my use of this Platform and has full knowledge of purchases made here. I understand that Flints are non-refundable once spent on any platform interaction."
InfluxTV relies on the payment verification performed by banks and payment gateways — which require the account holder to be 18 or older — as a reasonable mechanism for age verification, consistent with established industry practice in India.
Where a Viewer uses a Parent-Authorized Payment Instrument, the parent or legal guardian who controls that instrument is the contracting party for the Flint purchase. The minor user is the beneficiary. All obligations under these Terms and the Refund Policy bind the controlling parent or guardian.
InfluxTV does not independently market the Platform to individuals below 18 years of age. If we discover that an Account was created by a person under 18 without parental authorization, we reserve the right to immediately suspend or terminate that Account.
3.2 Minimum Age — Creators
Creators must be 18 years of age or older to register, host streams, and receive payouts. KYC verification — which requires submission of PAN card and bank account details — serves as an additional age eligibility gate, as these documents are issued only to adults. Minors may not register as Creators under any circumstance.
3.3 Geographic Eligibility
The Platform is currently available to users located in India. InfluxTV reserves the right to restrict access from jurisdictions where the operation of the Platform or the Flint economy may contravene local law.
04Account Registration and Security
4.1 Registration
To access interactive features of the Platform, you must create an Account by providing accurate, current, and complete information as prompted during the registration process. You agree to update this information promptly if it changes. At registration, you must accept these Terms and the Privacy Policy by actively checking separate mandatory checkboxes.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials, including your password. You agree to:
- Choose a strong, unique password and not share it with any third party
- Not allow any other person to access or use your Account
- Immediately notify InfluxTV at support@influxtv.in of any unauthorized use of your Account or any other breach of security
InfluxTV shall not be liable for any loss or damage arising from unauthorized use of your Account where such use was not attributable to a failure on our part.
4.3 One Account Per Person
Each individual may maintain only one Viewer Account and, if applicable, one Creator Account. Operating multiple accounts of the same type is prohibited and constitutes a violation of these Terms. InfluxTV reserves the right to merge, suspend, or terminate duplicate accounts without notice.
05The Flint Economy
5.1 Nature of Flints
Flints are the platform-native virtual currency of InfluxTV. They possess the following characteristics, each of which is a fundamental feature of the Platform and is accepted by every user as a condition of Account creation:
- Closed System: Flints are usable exclusively within the InfluxTV Platform. They cannot be used on any external platform, website, or service.
- Non-Transferable: Flints cannot be transferred, gifted, traded, or sold between user Accounts — whether on or off the Platform. Any attempt to facilitate off-platform exchange of Flints constitutes a violation of these Terms.
- Non-Redeemable: Flints cannot be converted back to real-world currency (INR) by Viewers under any circumstances, except as expressly provided in the Refund and Cancellation Policy in the event of platform discontinuation or account termination by InfluxTV for reasons other than the Viewer's breach of these Terms.
- Non-Expiring: Flints credited to a Viewer's Flint Wallet do not expire. They remain available for use as long as the Account is active and in good standing. InfluxTV does not charge inactivity fees or deduct Flints from inactive accounts.
- No Legal Tender: Flints do not constitute legal tender, money, securities, or any form of stored value under the laws of India or any other jurisdiction.
RBI Classification
Flints are a closed system prepaid instrument under the Reserve Bank of India's Master Direction on Prepaid Payment Instruments, 2021. Closed system PPIs do not require RBI authorisation as they are usable only within the issuing entity's ecosystem, are non-transferable, and are not redeemable for cash.
5.2 Purchasing Flints
Viewers may purchase Flints through the Flint Shop using supported payment methods including UPI, debit cards, credit cards, and net banking. All payments are processed through PCI-DSS compliant third-party payment gateways.
InfluxTV does not collect, store, or process payment card numbers, bank account details, CVVs, or raw UPI credentials at any point. Only transaction reference numbers, payment status, instrument type, and partial masked identifiers are received from the payment gateway for reconciliation purposes.
The Platform accepts any valid UPI Virtual Payment Address (VPA) entered by the user. InfluxTV does not implement any filtering, blocking, or special handling based on UPI handle format.
At every Flint purchase, before the payment gateway is invoked, a confirmation screen displays: the Flint amount being purchased, the INR amount being charged, and the age/authorization declaration. The user must actively confirm by pressing a clearly labelled button before the transaction proceeds.
5.3 Flint Pricing
Flint pricing is set by InfluxTV and may be updated from time to time. Prices displayed in the Flint Shop at the time of purchase are final. InfluxTV reserves the right to offer promotional pricing, discounts, or bonus Flint offers at its sole discretion. Such offers do not create any entitlement to future offers at the same or similar terms.
Composition of Pack Price: The price you pay for a Flint pack is the sum of two components: (a) the face value of the Flints credited to your Flint Wallet, at the fixed rate of ₹1 per Flint, and (b) a platform convenience fee, being the difference between the pack price and the face value of Flints awarded. This fee is InfluxTV's own revenue for operating the Flint Shop and is invoiced to you as such at the time of purchase, separately from the Flint face value. It is not refundable except as set out in the Refund and Cancellation Policy. The applicable fee for each pack is displayed at checkout before payment is confirmed.
5.4 Spending Flints
Flints may be spent on Platform Interactions including but not limited to:
- Live Bidding — competing in creator-launched bid events
- Poll Voting — casting paid votes in live polls
- POV Events — participating in point-of-view switching or control events
- Any other interactive feature introduced by InfluxTV that is denominated in Flints
Two-Step Confirmation
Every Flint spend on a Bid Event requires a mandatory two-step confirmation process:
- Step 1: The Viewer enters the bid amount and taps 'Place Bid'. No Flint deduction occurs at this stage.
- Step 2: A confirmation prompt displays the bid amount in Flints, the Viewer's wallet balance after the bid, and the name of the event. The Viewer must actively confirm. Only upon this second confirmation does the Flint deduction occur.
A bid confirmed through this two-step process is conclusively treated as intentional. No refund, reversal, or restoration of Flints is available for bids confirmed through this process, regardless of the outcome of the Bid Event.
FINALITY
Once Flints are deducted from a Viewer's Flint Wallet in connection with any Platform Interaction, those Flints are conclusively and irrevocably spent. This is the fundamental economic architecture of the Platform and is accepted by every Viewer as a condition of participation.
5.5 Flint Wallet Integrity
The Flint Wallet operates as a ledger-based system. Every credit (purchase) and debit (spend) is recorded as an individual ledger entry. The displayed wallet balance is the computed sum of all entries. Wallet balances are not stored as a single mutable field — they are derived from the immutable transaction ledger.
5.6 Video Interactions
Where a Viewer wins a Bid Event entitling them to a live video interaction with a Creator, that interaction takes place as part of the Creator's live stream and is visible to other Viewers watching that stream at the time. It is not a private call between the Viewer and the Creator.
InfluxTV records and stores footage of these video interactions, including the Viewer's participation in them, for the purposes of trust and safety moderation, and as evidence in the event of a grievance, complaint, or dispute raised by either the Viewer or the Creator. Recorded footage is retained in accordance with Clause 7 of the Privacy Policy and may be accessed internally by InfluxTV personnel handling such grievances, disputes, or safety investigations.
By participating in a video interaction, a Viewer acknowledges and consents to (a) the interaction being publicly visible to other Viewers of that stream, and (b) the interaction being recorded and retained by InfluxTV for the purposes set out in this Clause. This acknowledgment will be presented to the Viewer before the video interaction begins.
06Viewer Rights and Obligations
6.1 Rights
- Create and maintain an Account and access all publicly available Platform features
- Purchase Flints through the Flint Shop using supported payment methods
- Participate in live streams, Bid Events, polls, and other Platform Interactions
- Accumulate XP and progress through the level and leaderboard system
- Request refunds in the specific circumstances enumerated in the Refund and Cancellation Policy
- Exercise your data rights as set out in the Privacy Policy
- Submit complaints to the Grievance Officer and receive a response within the timelines prescribed by applicable law
6.2 Obligations
- Provide accurate and truthful information during registration and Flint purchase
- Maintain the confidentiality of your Account credentials
- Comply with all applicable Indian laws while using the Platform
- Not engage in any conduct that manipulates, exploits, or abuses the Flint economy, XP system, or leaderboard mechanics
- Not use automated tools, bots, scripts, or any non-human means to interact with the Platform
- Not harass, abuse, threaten, or impersonate any user, creator, or InfluxTV personnel
- Not attempt to reverse-engineer, decompile, or disassemble any part of the Platform
- Respect the intellectual property rights of InfluxTV, creators, and other users
07Creator Accounts
7.1 Creator Registration and KYC
Individuals seeking to host live streams and receive earnings must register as Creators and complete KYC verification. KYC requires submission of:
- PAN card number and a copy of the PAN card
- Aadhaar number (used for identity verification; only last 4 digits retained post-verification)
- Bank account number and IFSC code for payout processing
- Account holder name as it appears on the bank account
Creator payouts are hard-blocked until KYC verification is complete. A Creator without verified PAN cannot initiate a withdrawal under any circumstance.
7.2 Creator Wallet — Separation from Viewer Wallet
The Creator Wallet and the Viewer Wallet are architecturally separate systems at the database level. This separation is a structural requirement of the Platform's compliance architecture and is non-negotiable:
- The Creator Wallet is credited only from earnings generated through viewer interactions on the Creator's streams (bid revenue, poll revenue, etc.).
- The Viewer Wallet is credited only from Flint Shop purchases.
- Flints cannot be transferred between the Creator Wallet and the Viewer Wallet under any circumstance.
- If a Creator also uses the Platform as a Viewer, any Flint purchases they make are credited to their Viewer Wallet. Any Flints they spend on another Creator's stream are deducted from their Viewer Wallet — never from the Creator Wallet.
- Only the Creator Wallet has a withdrawal path. The Viewer Wallet has no withdrawal mechanism.
LEGAL BASIS: This wallet separation preserves InfluxTV's classification as a closed system PPI under the RBI Master Direction. If purchased Flints could flow into the Creator Wallet and be withdrawn as cash, the Flint economy would constitute a semi-closed PPI requiring RBI authorisation.
7.3 Platform Commission
InfluxTV retains a Platform Commission on all Creator earnings before payout. The current commission rate is 30% of gross Flint-based earnings. InfluxTV reserves the right to modify the commission rate upon 30 days' advance written notice to Creators. The revised rate will apply only to earnings generated after the effective date of the change.
7.4 TDS on Creator Payouts
Creator payouts are subject to Tax Deducted at Source (TDS) under Section 194-O of the Income Tax Act, 1961, as InfluxTV operates as an e-commerce operator making payments to e-commerce participants.
- TDS rate with verified PAN: 0.1% of the gross value of Flints withdrawn (face value, ₹1 per Flint), as per the rate prescribed by the Finance Act, 2024, effective 1 October 2024
- TDS rate without verified PAN: as prescribed under Section 206AA of the Income Tax Act, 1961 [rate under confirmation with InfluxTV's tax advisor; PAN-less withdrawal is in any event hard-blocked at the platform level, see Clause 7.1, so this rate does not apply to any live payout]
- TDS is computed on the gross value of Flints withdrawn at face value, before Platform Commission deduction — this is the legally correct basis under Section 194-O
- Individual and HUF Creators whose aggregate payments from InfluxTV in a financial year do not exceed Rs. 5,00,000, and who have furnished a valid PAN, are exempt from TDS under this Clause for that financial year
- Once a Creator's aggregate payments from InfluxTV in a financial year exceed Rs. 5,00,000, TDS applies to the full cumulative amount paid in that financial year, not merely the amount in excess of Rs. 5,00,000
- InfluxTV will file quarterly TDS returns (Form 26Q) and issue Form 16A certificates to Creators annually
Tax Collected at Source (TCS). Where a Creator is registered under the Goods and Services Tax framework and has furnished a valid GSTIN, InfluxTV will additionally collect TCS at 0.5% (0.25% CGST + 0.25% SGST) of the Creator's gross supply value under Section 52 of the CGST Act, 2017, and deposit it with the appropriate authority. TCS is not a cost borne by InfluxTV or an additional platform charge; it is an amount collected on the Government's behalf, and the Creator may claim credit for it against their own GST liability. TCS does not apply to Creators who have not furnished a GSTIN. InfluxTV will file monthly GSTR-8 returns reflecting TCS collected.
7.5 Creator Obligations
As a Creator, you agree to:
- Provide accurate and truthful KYC information
- Maintain the accuracy of your bank account and PAN details for payout processing
- Host streams in compliance with applicable Indian law and InfluxTV's content policies
- Not engage in misleading, deceptive, or manipulative conduct toward Viewers, including falsely inflating bid expectations or rigging event outcomes
- Accept that Platform Commission and TDS deductions are non-negotiable terms of the Creator arrangement
- Promptly report any discrepancies in earnings, payouts, or TDS deductions to support@influxtv.in
08XP, Levels, and Leaderboards
8.1 Nature of XP
XP (Experience Points) is a non-monetary, non-transferable, non-redeemable metric that accrues based on platform participation. XP has no cash value and cannot be exchanged, sold, or converted into Flints, real-world currency, or any other form of value. XP exists solely for the purpose of leaderboard ranking and level progression within the Platform.
8.2 Viewer XP
Viewers earn XP through the following actions: watching live streams, liking streams, following creators, sending chat messages during live streams, placing bids, winning bids, and purchasing Flints. The XP values, diminishing returns curves, and streak multipliers applicable to Viewer XP are determined by InfluxTV and published in the Platform's XP documentation. InfluxTV reserves the right to adjust XP values at any time to maintain system balance.
8.3 Creator XP
Creators earn XP through hosting streams, launching interactive events, and generating viewer participation. Creator XP is driven primarily by audience engagement metrics including participation rate, returning viewer ratio, bids placed by viewers, and community growth. The XP values and bonus tiers applicable to Creator XP are determined by InfluxTV.
8.4 Leaderboards
The Platform maintains two categories of leaderboards:
- In-Stream Leaderboard: XP earned during a specific stream session only. Resets per stream. Displays the most active participants in that session.
- Global Leaderboard: Cumulative lifetime XP across all streams. Platform-wide ranking for both Viewers and Creators.
Leaderboard positions are determined solely by XP accumulation. InfluxTV does not manually adjust leaderboard rankings. Any user found to be manipulating XP or leaderboard positions through automated means, account sharing, or exploitation of technical vulnerabilities will be subject to Account termination and forfeiture of all Flints and XP.
8.5 No Entitlement
XP, levels, badges, and leaderboard positions do not create any legal right, entitlement, or claim against InfluxTV. InfluxTV reserves the right to reset, recalculate, or modify XP balances if system errors or exploitation are detected, without prior notice.
09Content Standards and Prohibited Conduct
9.1 User-Generated Content
Users may submit content to the Platform through live chat, stream interactions, and profile information. By submitting content, you represent that you have all necessary rights to the content and that it does not infringe the intellectual property rights of any third party.
You grant InfluxTV a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your submitted content solely for the purpose of operating and promoting the Platform. This license terminates upon Account deletion, except for content that has been shared with other users or incorporated into platform records during your use.
9.2 Creator Content
Content streamed by Creators remains the intellectual property of the respective Creator. InfluxTV does not claim ownership of Creator content. However, Creators grant InfluxTV a non-exclusive, royalty-free license to display, distribute, cache, and promote stream content within and in connection with the Platform for operational and promotional purposes.
9.3 Prohibited Content
The following content is strictly prohibited on the Platform:
- Content that is unlawful, defamatory, obscene, pornographic, or harmful under applicable Indian law
- Content that promotes or incites violence, hatred, discrimination, or terrorism
- Content that infringes the intellectual property, privacy, or other rights of any third party
- Content that is misleading, deceptive, or fraudulent
- Content that targets or exploits minors in any manner
- Spam, unauthorized advertising, or unsolicited commercial communications
- Content that disrupts or interferes with the operation of the Platform or the experience of other users
9.4 Prohibited Actions
The following actions are strictly prohibited:
- Use of bots, scripts, automated tools, or any non-human means to access the Platform, interact with features, or manipulate the Flint economy, XP, or leaderboard
- Creating or operating multiple accounts of the same type
- Sharing Account credentials with third parties or allowing others to access your Account
- Attempting to exploit bugs, glitches, or vulnerabilities in the Platform for personal gain
- Chargebacks or payment disputes initiated in bad faith — where a Viewer initiates a chargeback on a legitimate Flint purchase after spending the Flints
- Collusion between users to manipulate bid outcomes or XP accumulation
- Any form of harassment, bullying, threats, or abuse directed at other users, creators, or InfluxTV personnel
9.5 Content Moderation
InfluxTV reserves the right to remove, restrict, or modify any content that violates these Terms, without prior notice to the user who posted it. Repeated violations will result in escalating consequences from temporary suspension to permanent Account termination.
10Intellectual Property
10.1 Platform IP: All intellectual property in and to the Platform — including but not limited to source code, design, layout, user interface, trademarks, logos, brand names, and proprietary algorithms — is owned by or licensed to InfluxTV. No right, title, or interest in any Platform IP is transferred to you by virtue of these Terms or your use of the Platform.
10.2 Restrictions: You may not copy, reproduce, modify, adapt, or create derivative works from any part of the Platform; distribute or publicly display Platform content; use InfluxTV trademarks; scrape or use automated means to extract data; or reverse-engineer any software without written consent.
10.3 Feedback: If you submit feedback, suggestions, or ideas regarding the Platform, you grant InfluxTV an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
11Third-Party Services
The Platform may contain links to or integrations with third-party services, including payment gateways, social media platforms, and analytics providers. InfluxTV does not control, endorse, or assume responsibility for the content, privacy practices, or availability of third-party services. Your use of third-party services is governed by those services' own terms and policies.
Payment transactions are processed by independent, PCI-DSS compliant payment gateway providers. InfluxTV is not responsible for payment processing errors, delays, or failures attributable to the payment gateway, your bank, or your payment instrument provider.
12Disclaimers
12.1 Platform Availability: The Platform is provided on an "as is" and "as available" basis. InfluxTV does not warrant or guarantee that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We may suspend or restrict access to the Platform for maintenance, upgrades, or other operational reasons without prior notice.
12.2 Stream Content: InfluxTV does not endorse, verify, or assume responsibility for the content, quality, accuracy, or legality of any live stream, statement, or communication made by any Creator on the Platform. Creators are independent users, not employees, agents, or representatives of InfluxTV.
12.3 Interaction Outcomes: InfluxTV does not guarantee any particular outcome from any Platform Interaction. Bid outcomes, poll results, and event dynamics are determined by the mechanics of the specific event and the actions of participating users. InfluxTV does not manipulate, predetermine, or guarantee the outcome of any interactive event.
12.4 No Investment Advice: Flints are not investments. The purchase of Flints should not be made with the expectation of profit, appreciation, or return. Flints are a consumption good used to access interactive features and have no secondary market value.
13Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- InfluxTV shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or in connection with your use of the Platform, including but not limited to loss of data, loss of profits, or loss of goodwill
- InfluxTV's total aggregate liability to a Viewer for any and all claims arising from or related to these Terms or the Platform shall not exceed the total amount that Viewer has paid to InfluxTV for Flint purchases in the 12 calendar months immediately preceding the event giving rise to the claim
- InfluxTV's total aggregate liability to a Creator for any and all claims arising from or related to these Terms or the Platform shall not exceed the total Platform Commission retained by InfluxTV from that Creator's earnings in the 12 calendar months immediately preceding the event giving rise to the claim
- InfluxTV is not liable for losses arising from: Creator actions, stream content, or event outcomes; third-party payment gateway failures; unauthorized access to your Account due to your failure to maintain credential security; force majeure events; delays, failures, or errors in Creator payouts caused by inaccurate, incomplete, or outdated KYC, bank account, or GSTIN information provided by the Creator
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of Indian law, including liability for fraud or gross negligence.
14Termination and Suspension
14.1 Termination by You
You may delete your Account at any time through your Account settings. Upon Account deletion:
- All personal data will be handled in accordance with the Privacy Policy
- All unspent Flints in your Viewer Wallet are forfeited
- XP, levels, badges, and leaderboard positions are permanently removed
- Account deletion is irreversible once confirmed
14.2 Termination by InfluxTV — For Cause
InfluxTV may suspend or permanently terminate your Account, with or without notice, if you violate any provision of these Terms, including but not limited to:
- Engaging in fraud, manipulation, or abuse of the Flint economy or XP system
- Using automated tools, bots, or scripts
- Harassing other users or creators
- Initiating bad faith chargebacks
- Operating multiple accounts
- Posting prohibited content
Upon termination for cause: all remaining Flints in the Viewer Wallet are forfeited. All Creator Wallet earnings pending payout are forfeited. No refund of any kind is available. XP and leaderboard positions are permanently removed.
14.3 Termination by InfluxTV — Without Cause
InfluxTV may terminate your Account for reasons other than your breach of these Terms, including but not limited to platform discontinuation or business restructuring. In such cases:
- InfluxTV will provide a minimum of 30 days' advance notice
- Unspent Flints in the Viewer Wallet will be refunded at the Flint purchase rate, calculated on a first-in first-out basis
- Creator Wallet earnings due will be paid out in accordance with the standard payout process, subject to TDS deduction
14.4 Survival
The following provisions survive the termination of these Terms and your Account: Clauses 5 (Flint Economy — to the extent of transaction finality), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 15 (Indemnification), 17 (Governing Law), and any other provisions that by their nature are intended to survive termination.
15Indemnification
You agree to indemnify, defend, and hold harmless InfluxTV, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your breach of any provision of these Terms
- Your use of the Platform in violation of applicable law
- Any content you submit to the Platform
- Your infringement of the intellectual property or other rights of any third party
- Any dispute between you and another user or Creator arising from your use of the Platform
16Dispute Resolution
16.1 Internal Grievance Redressal: Any complaint or dispute arising from these Terms or the use of the Platform should first be addressed through InfluxTV's internal grievance redressal mechanism by submitting a written complaint to support@influxtv.in with details of the issue and any supporting documentation. InfluxTV will acknowledge receipt within 24 hours and a response or resolution will be provided within 30 days of receipt.
16.2 Escalation: If you are not satisfied with the resolution provided through the internal mechanism, you may escalate to InfluxTV's Grievance Officer, Parth Nangia, at legal@influxtv.in. If unresolved, the dispute may be referred to the Consumer Disputes Redressal Commission having jurisdiction under the Consumer Protection Act, 2019.
These Terms do not limit or exclude any statutory rights you may have under applicable Indian consumer protection law.
+Additional Legal Provisions
17. Governing Law and Jurisdiction: These Terms are governed by and shall be construed in accordance with the laws of India. Any legal proceedings arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Faridabad, Haryana, India.
18. Force Majeure: InfluxTV shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, civil unrest, power failures, internet disruptions, cyberattacks, or third-party service failures. During a force majeure event, InfluxTV's obligations are suspended for the duration of the event.
19. Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if such modification is not possible, it shall be severed from these Terms.
20. Waiver: No failure or delay by InfluxTV in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A single or partial exercise of any right does not preclude any other or further exercise of that right or the exercise of any other right.
21. Entire Agreement: These Terms, together with the Privacy Policy and the Refund and Cancellation Policy, constitute the entire agreement between you and InfluxTV with respect to your use of the Platform. They supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter hereof.
22. Amendments: InfluxTV reserves the right to modify, amend, or update these Terms at any time. Material amendments will be communicated to you by a prominent notice on the Platform, and/or an email to your registered email address, and/or a prompt requiring acknowledgment upon your next login to the Platform.
Continued use of the Platform following notification of amendments constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must discontinue use of the Platform and may request Account deletion. Non-material changes (such as typographical corrections or formatting changes) may be made without notice.
